Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the PMUMagic Retouch Studio website, applications and related services (the “Service”), operated by Red Moon Marketing FZCO (“PMUMagic”, “we”, “us”). By creating an account, purchasing credits or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

PMUMagic provides automated, AI-assisted photo retouching and related tools (collages, exports, color matching, sharing pages, public portfolios) aimed at permanent-makeup (PMU) professionals. The Service processes the photos you upload and returns edited versions. Features may change, be added or be removed at any time.

2. Accounts

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

3. Credits and purchases

• Features are paid for with credits. Credit costs are shown in the app before each action.
• Plan (subscription) credits refresh each billing cycle and unused plan credits expire at the end of the cycle; they do not roll over.
• Week Pass credits are valid for 7 days from purchase.
• One-time pack credits do not expire.
• Credits are personal, non-transferable, cannot be resold and have no cash value.
• Subscriptions renew automatically each month until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing cycle.
• Prices may change; changes never apply retroactively to credits you already bought.
• Promotional offers (for example launch bonuses) are discretionary, may be limited in quantity and time, and may be modified or withdrawn at any time.

Payments are processed by Stripe. Refunds are handled as described in our Refunds & Credits Policy.

4. Your content and your responsibilities

You keep full ownership of every photo you upload and of every result the Service produces from it. You grant us a limited, worldwide, non-exclusive license to host, process, reproduce and display your photos solely to operate the Service at your direction (for example to run a retouch, to store an image behind a share link you created, or to show works you added to your public portfolio). This license ends when you delete the content or your account, except for content you have chosen to keep publicly shared.

You represent and warrant that:

• you own the photos you upload or have all rights needed to use them;
• every identifiable person in a photo (including your clients) has given you valid consent for the photo to be uploaded, processed, edited and, where you use sharing features, published;
• your use of retouched photos in advertising or client communication complies with the laws and professional rules that apply to you, including any rules on before/after imagery in your jurisdiction;
• you will not upload content that is unlawful, defamatory, sexually explicit, depicts minors, or infringes anyone’s rights.

We do not review your content, and responsibility for it and for how you use the results rests entirely with you. We may remove content or disable sharing links that we reasonably believe violate these Terms or the law.

5. Acceptable use

• Do not interfere with or disrupt the Service, probe or test its security, or access it by automated means (scraping, bots) without our written permission.
• Do not reverse engineer, resell, sublicense or white-label the Service.
• Do not use the Service to create misleading, deceptive or unlawful imagery, or to misrepresent treatment results to consumers.
• Do not share your account or circumvent credit accounting, free-credit or referral mechanics.

6. AI processing, no guarantee of results

Retouching is performed by automated AI systems. Results are generated without human review, may contain errors or artifacts, and may vary between runs. While the Service is designed to leave pigmented areas (brows, lips, liner) unaltered, you must review every result before using it professionally. The Service is a photo-editing tool; it provides no medical, cosmetic or professional advice, and no guarantee that any particular result will be achieved.

7. Sharing features

Share links and public portfolio pages you create are accessible to anyone who has the link. You decide what to share and can stop sharing at any time from the app. We may disable public pages that violate these Terms.

8. Intellectual property

The Service, including its software, design, branding and content we created, is owned by us or our licensors and is protected by intellectual-property laws. These Terms give you no rights in the Service other than the limited right to use it as intended.

9. Third-party services

The Service relies on third-party providers (including payment, authentication, hosting and AI processing providers). Their availability is outside our control, and their terms may apply to the parts of the Service they power.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT ANY RESULT WILL MEET YOUR EXPECTATIONS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

12. Indemnification

You will indemnify and hold us harmless from any claims, damages and costs (including reasonable legal fees) arising from your content, your breach of these Terms, or your violation of any law or of any third party’s rights, including claims by persons depicted in photos you uploaded.

13. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including 4, 8, 10, 11, 12 and 14) survive.

14. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates as applicable in the Emirate of Dubai, without regard to conflict-of-law rules. The courts of Dubai have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where the mandatory consumer-protection law of your country of residence provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app or by email. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
